Terms of sale
In short: a one-time payment gives you a license that unlocks the Pro features of every extension in the Vibevalse Suite, today's and tomorrow's, as long as Vibevalse publishes them. Payment is processed by Polar, our merchant of record. You can get a refund within 14 days of your purchase.
1. Who sells what
- The publisher. Vibevalse SRL, Rue du Val Saint-Lambert 73, 4100 Seraing, Belgium, company number 1042.350.419, VAT BE 1042.350.419, publishes the extensions and provides the license. Contact: [email protected].
- The reseller. The sale is made with Polar Software, Inc. (United States), acting as merchant of record: Polar collects the payment, issues the invoice and applies taxes. Polar's terms apply to the payment, in addition to these terms.
2. What you buy
- The license. A personal license, paid once, with no subscription. It unlocks the Pro features of every extension in the Vibevalse Suite: those available on the day of purchase (Modern EyeDropper & Color Picker, FocusLock) and those that join the Suite afterwards.
- The Vibevalse Suite. It includes the extensions presented as part of the Suite on vibevalse.com. Vibevalse chooses which extensions join it. An extension that is part of the Suite on the day of your purchase, or that joins it afterwards, is never removed from it to be sold separately. Other products Vibevalse may offer are not part of it.
- “Lifetime”. Access is guaranteed as long as Vibevalse publishes and maintains the extensions concerned, not for the buyer's lifetime. If Vibevalse discontinues an extension, it may stop working; the other extensions covered by the license remain available.
- Changes to the extensions. Vibevalse may change the extensions and their Pro features, for example to improve them, adapt them to Chrome changes or fix a security issue, at no extra cost to you. If a change significantly reduces your access to a Pro feature or its usefulness, you are told in advance, by email or in the extension. You can then end your license within 30 days of being told and get a proportionate refund, as provided by law.
- Future extensions. The published roadmap (for example Pixform and Snapveil) is indicative: the names, dates and content of future extensions are not guaranteed, nor is their number.
- Activations. Each extension activated on a browser uses one activation of your license. A license currently has 15 activations in total. Vibevalse may raise this number as the Suite grows; it never goes down for a license already bought. You can free an activation from the extension or from your Polar customer portal.
- Use. The license is for one person. Sharing or reselling it may lead to its deactivation, after a warning sent by email.
3. Price
- Price: €19.99, or $19.99 (US dollars) depending on your country: the checkout page shows the currency that applies. In the European Union, the United Kingdom and most other countries, this price includes VAT or local tax. In the United States, Canada and India, the applicable tax is added at checkout. The exact amount is shown before you pay.
- Price changes. Vibevalse may raise the price as the Suite grows. The applicable price is the one shown at the time of purchase. An increase does not apply to licenses already bought, which keep exactly the same rights; nothing more is asked.
- Taxes. Polar calculates VAT or sales tax for your country and shows it before payment.
- A later price decrease or a promotion does not entitle you to a partial refund.
4. Delivery
The license key shows on Polar's confirmation page right after payment. It is also sent by email and stays available in the Polar customer portal. It is entered in the options of each extension.
5. Withdrawal and refund
- 14-day refund. You can ask for a full refund of your purchase within the following 14 days, without giving a reason, by writing to [email protected] from the email address used for the purchase. The refund is made by Polar, to the payment method used, and the license is deactivated.
- Right of withdrawal. This refund covers at least the 14-day right of withdrawal that European law gives consumers. You keep it even after receiving and using your license key.
- After 14 days. A refund remains possible if a defect prevents you from using the Pro features and Vibevalse does not fix it within a reasonable time.
6. Warranties and liability
- The extensions are provided as is. Vibevalse fixes reported defects within a reasonable time, but does not guarantee that they will work on every page, or after a Chrome change that would make them impossible to maintain.
- Except in case of gross negligence or intent, Vibevalse's liability is limited to the amount paid for the license.
- Nothing in these terms limits the rights the law gives consumers, in particular the legal guarantee of conformity for digital content.
7. Personal data
How your data is processed during the purchase and the license check is described in each extension's privacy policy: Modern EyeDropper & Color Picker, FocusLock.
8. Changes, governing law and disputes
- Vibevalse may change these terms; the applicable version is the one in force on the day of your purchase.
- These terms are governed by Belgian law. If you are a consumer, you keep the protection of the mandatory rules of your country of residence.
- In case of disagreement, first write to [email protected]. If no amicable solution is found, you can refer the matter to the Belgian Consumer Mediation Service (mediationconsommateur.be) or the competent courts.
